1. The Contract
In these terms and conditions (“Conditions”), "the Company", "we" or "us" means Emerald Travel & Tourism, a division of Emerald International Trading Group.
The Booking Form, these Conditions, the brochures (if any) of which the Booking Form forms a part, information on our website, and any acceptance of a booking by the Company shall form the sole basis of the contract between the Company and the person signing the Booking Form (“Client” or “you”) and us (the “Contract”).
The Contract is governed exclusively by the laws of the UAE and the applicable federal laws of the United Arab Emirates, and the UAE Courts shall have exclusive jurisdiction to determine any dispute or claim that arises out of or in connection with the Contract.
These Conditions apply equally to you and to all persons named in your booking. When you make your booking, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these Conditions.
The Client who signs the Booking Form or makes and pays for the booking must be at least 21 years old.
2. Booking and Payments
To confirm a booking, the Client must complete and sign the Booking Form and pay the required deposit or full payment as specified.
Payments can be made by cash, credit card, or bank transfer, subject to the Company’s discretion and the applicable terms.
Full payment must be received by the Company before the commencement of the booked services, unless otherwise agreed in writing.
Any additional charges incurred during the provision of services shall be paid by the Client promptly upon request.
3. Cancellations and Amendments
Cancellations or amendments to bookings must be notified to the Company in writing and are subject to applicable cancellation or amendment fees.
The Client acknowledges that certain services may be non-refundable or subject to specific cancellation terms imposed by third-party suppliers.
The Company reserves the right to cancel or amend bookings due to unforeseen circumstances or force majeure events. In such cases, alternative arrangements or a refund may be offered at the Company’s discretion.
4. Travel Documents and Insurance
It is the Client’s responsibility to ensure that all travel documents, including passports, visas, and health certificates, are valid and obtained in a timely manner.
The Company may provide assistance in obtaining visas or other travel documents, but it does not guarantee their approval or issuance.
The Client is strongly advised to obtain comprehensive travel insurance to cover unforeseen events, including but not limited to cancellations, medical emergencies, and travel disruptions.
5. Liability and Indemnity
The Company acts as an agent for third-party service providers and shall not be liable for any loss, injury, or damage arising from the acts or omissions of such providers.
The Company shall not be liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits, arising out of or in connection with the provision of services.
The Client agrees to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, liabilities, or expenses arising from the Client’s breach of these Conditions or any negligent or willful act or omission.
6. Miscellaneous
These Conditions constitute the entire agreement between the Client and the Company and supersede any prior agreements or understandings, whether written or oral.
No modification or waiver of these Conditions shall be effective unless in writing and signed by both parties.
If any provision of these Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
By signing the Booking Form or accepting our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
